|§ 02||General, Scope of Application
All services provided by the Best of Moringa Internet Shop for the customer are provided exclusively on the basis of the following General Terms and Conditions. Deviating regulations are only valid insofar as they have been agreed in writing between the Best of Moring Internet Shop and the customer or are expressly named in these General Terms and Conditions.
|§ 03||Conclusion of the contract
Before submitting your order, in the last step of your order, you will be given the opportunity to check all details (e.g. name, address, payment method and items ordered) again and change them if necessary. If you have gone through the order process by inserting the information required there and click on the button "Send order" in the last step of the order, you are submitting a binding offer to our Internet shop.
By placing an order, the customer declares that he is of legal age and legally competent.
The contract is concluded subject to the availability of the ordered goods or services. If the Best of Moringa Internet shop cannot accept the offer of the customer, this will be communicated to the customer in electronic form.
With the conclusion of the contract, the customer agrees to these General Terms and Conditions and is bound by them. The Best of Moringa Internet shop does not recognize deviating conditions of the customer, unless he agrees specifically in written form to their validity.
|§ 04||Prices, delivery, shipping costs
The prices are inclusive of VAT. The Best of Moringa Internet shop will send the ordered goods to the address indicated by the customer in the order as soon as possible.
The dispatch takes place by post parcel or parcel service. If we should have delivery bottlenecks with articles ordered by you, we inform you immediately by e-mail the prospective date of delivery. The Best of Moringa Internet shop is entitled to partial deliveries.
The delivery takes place at the shipping costs stated in each individual case. Information about the expected delivery period is not binding. The Best of Moringa Internetshop does not assume any liability for damages caused by the transport of the mail or the carrier.
|§ 05||Retention of ownership
The delivered goods remain the property of Best of Moringa Internetshops until full settlement of all existing claims against the customer.
|§ 06||Due date and payment
Payment is possible by prepayment, credit card and PayPal.
|§ 07||Loss of deadline:
In the event of default in payment, we shall be entitled to demand the costs for our dunning expenses (a maximum of EUR 11.55 per dunning notice), the additional account management or evidence maintenance expenses of at least EUR 14.90 and a maximum of EUR 49.90 as well as the dunning and collection expenses for the debt collection agencies and lawyers employed by us which are necessary for the appropriate prosecution. In the case of collection agencies, these are based on the collection agencies' statutory rates, in the case of lawyers on the lawyer's tariff.
|§ 08||Revocation instruction for private customers
You can revoke your contract explanation within two weeks without indication of reasons in text form (e.g. letter, E-Mail). The period begins at the earliest with receipt of the order confirmation. The timely dispatch of the revocation via letter or e-mail shall suffice to comply with the revocation period. The revocation is to be directed to the above address of the mail order company.
Consequences of revocation:
The costs of returning the goods shall be borne by the customer.

Only then your articles can be taken back and the invoice amount refunded.
|§ 09||Liability for Defects
The Best of Moringa Internet Shop will be responsible for defects that are present at the time of delivery of the goods during a warranty period of three months in accordance with the following rules. The customer will immediately inform us in writing of any defects that may occur. If the Best of Moringa Internet Shop is responsible for a defect, the company will remedy this at the discretion of the customer by eliminating the defect or by delivering a replacement. If the removal of defects or replacement delivery fails, if the Best of Moringa Internet Shop is not willing or able to do so, or if this is delayed beyond unreasonable periods for reasons for which the mail order company is responsible, the customer is entitled to withdraw from the contract or to demand a reduction of the purchase price without prejudice to any claims for damages.
The Best of Moringa Internet Shop is only liable for damages caused intentionally or by gross negligence. A liability for damages of the Best of Moringa internet shop is excluded in case of slight negligence except for personal injury. Liability for force majeure, consequential damage and loss of profit is also excluded. Compensation for damage to property is excluded if it was suffered by an entrepreneur who used the item predominantly in his company.
|§ 11||Data protection
The data required for processing the order shall be stored and treated confidentially in compliance with the provisions of the Austrian Data Protection Act.
|§ 12||Place of performance, jurisdiction
Place of performance and jurisdiction is the registered office of Best of Moringa.
Austrian law is to be applied to the exclusion of the reference norms to foreign law and the UN Convention on Contracts for the International Sale of Goods.
|§ 13||Severability clause
Should any provision of this contract be or become invalid or unenforceable, the remaining provisions of this contract shall remain unaffected thereby.
